Welcome to SwapSee (“SwapSee”, “we”, “our”, “us”).

These Terms and Conditions (“Terms”) govern your access to and use of the SwapSee mobile application, website, and related services (collectively, the “Platform”).

By accessing or using SwapSee, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

SwapSee is a user-to-user marketplace platform that allows individuals to list, discover, and arrange swaps or future purchases of fashion and lifestyle items.

SwapSee is a facilitator only. We do not own, buy, sell, inspect, store, or take possession of items listed on the Platform.

You must:

• Be at least 18 years old, or
• Be at least 16 years old with parental/guardian consent

By using SwapSee, you confirm that you meet these requirements.

We reserve the right to suspend or terminate accounts that do not meet eligibility criteria.

To use certain features, you must create an account.

You agree to:

• Provide accurate and current information
• Keep your login details secure
• Be responsible for all activity under your account

SwapSee is not liable for loss resulting from unauthorised access due to your failure to secure your account.

You may upload photos, descriptions, and other content (“User Content”) to list items.

By uploading content, you:

• Confirm you own the item or have the legal right to list it
• Confirm the content is accurate and not misleading
• Grant SwapSee a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and promote your content in connection with operating and marketing the Platform

You must not upload content that:

• Is false, deceptive, or fraudulent
• Infringes intellectual property rights
• Contains offensive, abusive, or unlawful material
• Violates any Australian law

We reserve the right to remove listings or content at our discretion.

SwapSee facilitates introductions between users. All swaps or transactions are solely between users.

SwapSee is not a party to any agreement between users.

We do not guarantee:

• The quality, authenticity, or condition of items
• That a user will complete a swap
• The accuracy of listings

Users transact at their own risk.

At present, payments may not be processed within the Platform.

If and when in-app payments are introduced:

• SwapSee may use a third-party payment processor
• Additional Payment Terms may apply
• Fees may be introduced and will be disclosed clearly

SwapSee is not responsible for third-party payment processor failures.

SwapSee may introduce:

• Listing fees
• Boost or promotional fees
• Transaction or service fees

All fees will be clearly displayed before payment is required.

We reserve the right to change fees with reasonable notice.

Users must not list:

• Counterfeit goods
• Stolen items
• Weapons
• Illegal substances
• Hazardous materials
• Any item prohibited under Australian law

We reserve the right to remove prohibited listings and suspend accounts.

Users are responsible for:

• Arranging safe meet-ups
• Using secure delivery methods
• Verifying items before completing swaps

SwapSee is not responsible for loss, theft, injury, or damage arising from user interactions.

All Platform content (excluding User Content), including logos, branding, text, graphics, and software, is owned by SwapSee and protected by intellectual property laws.

You may not copy, reproduce, or exploit our content without written permission.

To the maximum extent permitted by Australian law:

• SwapSee is not liable for indirect, incidental, or consequential loss
• Our total liability is limited to the amount paid by you to SwapSee in the 12 months prior to the claim (or AUD $100 if no payments were made)

Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.

You agree to indemnify and hold SwapSee harmless from any claims, losses, damages, or legal fees arising from:

• Your breach of these Terms
• Your listings or transactions
• Your violation of any law or third-party rights

We may suspend or terminate your account if you:

• Breach these Terms
• Engage in fraudulent behaviour
• Create safety risks for others

You may delete your account at any time.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and store personal information.

We may update these Terms from time to time.

Continued use of SwapSee after changes are published constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Queensland, Australia.

Any disputes will be subject to the courts of Queensland.
